The Private Rented Sector Licensing Policy sets out our approach in implementing the Licensing provisions set out within the Housing Act 2004 (as amended by the Housing and Planning Act 2016).

The Act gives Local Authorities powers to licence certain types of housing in the private rented sector. This includes:

  • powers to licence all Houses in Multiple Occupation (HMOs) meeting specific criteria; and
  • discretionary powers to designate areas of the City for Selective Licensing and additional HMO Licensing.

Our HMO Standards apply to all HMO’s within the city regardless of whether they need a licence or not. They are based on legislation and official guidance as well as our expectations of HMOs in the City.

We recognise the valuable role that the private rented sector plays in offering choice and flexibility to Manchester residents.

Property within the private rented sector can provide affordable housing options for some of the most vulnerable and disadvantaged groups in society including:

  • those claiming benefits 
  • those on low incomes
  • students 
  • asylum seekers

What we are doing

We have reviewed and made some proposed changes to our policy to ensure that this significant part of the housing market offers safe and well- managed properties as well as meets the city's current and future needs.

  • We will ensure that this type of accommodation is regulated to protect the health, safety and welfare of tenants, but also to safeguard local communities from the impact of antisocial behaviour which may result from inadequate management.
  • As part of a regular review of our enforcement policies we have updated our policy documents to give more clarity between HMO licensing and selective licensing. With small changes to include:
    • new legislation and guidance  
    • case laws that affect our processes, 
    • decisions of residential property tribunals (not case law but show good practice and interpretation of the law)
